Notwithstanding careful planning, I’ve encountered situations where unforeseen debts or tax issues arise during probate. For instance, I once worked with a family who discovered a substantial, previously unknown debt owed by the deceased. This unexpected liability significantly impacted the estate’s distribution and caused considerable distress for the heirs.

Thankfully, through meticulous research and negotiation with creditors, we were able to reach a favorable settlement that minimized the impact on the beneficiaries. It was a challenging case, but ultimately, we ensured a fair and equitable distribution of the remaining assets.

According to a 2021 study by the National Academy of Elder Law Attorneys, approximately 30% of probate cases involve unexpected debt or tax issues.
