Good evening, Moreno Valley, and welcome back to “Legal Matters.” I’m your host, Maria Rodriguez, here tonight with Steve Bliss, a highly respected probate attorney serving our community. Mr. Bliss, thank you so much for joining us.
Probate: What is it, and why should people care?
Steve Bliss: Thanks for having me, Maria. Probate is essentially the legal process of administering a deceased person’s estate. This involves identifying and valuing assets, paying off debts and taxes, and ultimately distributing the remaining property to heirs according to the will or state law.
What are some common misconceptions about probate?
Steve Bliss: One misconception is that probate is always lengthy and expensive. While complex estates can take time, many straightforward cases are resolved efficiently. Another myth is that probate is only necessary for wealthy individuals. In reality, anyone who owns assets needs to consider probate planning.
What type of Trust do you often recommend?
Steve Bliss: Consequently, I frequently recommend revocable living trusts to my clients. They offer a number of advantages, including avoiding probate, maintaining privacy during the distribution process, and allowing for flexibility in managing assets during one’s lifetime. Moreover, they can be easily modified or revoked as circumstances change.
How does a Revocable Living Trust work?
Steve Bliss: A revocable living trust is created by the grantor (the person setting up the trust). They transfer ownership of their assets into the trust and designate a trustee to manage those assets. Ordinarily, the grantor serves as both the creator and the trustee during their lifetime. Upon the grantor’s death, the successor trustee named in the trust document takes over and distributes the assets according to the grantor’s wishes.
One of the key benefits of a revocable living trust is that it avoids probate. This means that the assets in the trust don’t have to go through the court process, which can be time-consuming and expensive. Another advantage is privacy. Since probate records are public, using a trust keeps your financial affairs confidential.
Have you ever encountered any issues with Revocable Living Trusts?
Steve Bliss: While revocable living trusts are generally effective tools, there have been instances where clients didn’t fully understand the implications or neglected to update their trust documents as their circumstances changed. I recall one case where a couple created a trust but forgot to transfer ownership of their primary residence into it. This oversight led to complications during probate, highlighting the importance of careful planning and ongoing review.
