How Did You Get Started in Conservatorship Law?
“Well,” Ted chuckled, leaning back in his chair, “it wasn’t exactly a straight path. I started out focusing on estate planning but quickly realized how intertwined it was with conservatorships. Seeing families struggle to navigate this complex legal process sparked my passion for helping them through it.”
What Are the Most Common Types of Conservatorships You Handle?
“I see a lot of Conservatorship of the Estate cases,” Ted explained. “These involve managing the financial affairs of someone who can’t do it themselves due to age, illness, or disability. But I also handle Conservatorships of the Person, where we focus on making decisions about an individual’s personal care and well-being.”
Could You Walk Us Through the Process of Establishing a Conservatorship?
Ted nodded enthusiastically. “It all starts with filing a petition in probate court, outlining why a conservatorship is necessary. Then comes the crucial step of notifying everyone involved – the proposed conservatee, their family members, and anyone else who might have an interest.”
“The court appoints an investigator to look into the situation, and a medical or psychological evaluation is usually required to assess the individual’s capacity. Finally, there’s a hearing where the judge reviews all the evidence and decides whether to grant the conservatorship.”
Responsibilities of a Conservator: A Balancing Act
“Being a conservator is a big responsibility,” Ted emphasized. “They owe a fiduciary duty to the conservatee, meaning they must always act in their best interest. This involves managing finances carefully, making decisions about healthcare and living arrangements, and regularly reporting to the court.”
- “It’s like being a trustee for someone else’s life,” Ted said.
- “You have to be organized, compassionate, and able to make tough decisions.”
“One time I had a case where the conservatee was adamant about refusing medical treatment,” Ted recalled. “It was a heartbreaking situation because we knew the treatment could prolong their life. Ultimately, the court had to weigh the conservatee’s wishes against their best interests, which led to some difficult conversations with everyone involved.”
