Not every estate requires probate. Ordinarily, smaller estates valued below a certain threshold ($184,500 in California) can avoid probate altogether. Assets held in trusts or jointly owned with rights of survivorship also typically bypass probate.
However, for estates exceeding that value or containing assets not covered by these exemptions, probate becomes necessary to ensure a lawful and orderly distribution of the deceased person’s possessions.

Certainly. This stage is crucial because it involves settling all outstanding financial obligations of the deceased individual before any assets are distributed to heirs. As executor or administrator, I work diligently to identify and notify all known creditors.
Valid claims are paid from estate funds. Conversely, if a creditor’s claim appears questionable or lacks sufficient documentation, I may contest it on behalf of the estate.
Paying federal and state taxes is another vital aspect of this step. According to the IRS, roughly 40% of estates owe some form of federal estate tax. Properly calculating and filing these returns ensures compliance with the law and avoids potential penalties down the road.
I recall one instance where a client inherited a significant sum from their late parent. Unfortunately, the deceased hadn’t filed taxes for several years.
It was a complex situation, requiring me to meticulously reconstruct financial records and work closely with the IRS to resolve the outstanding tax liability before we could proceed with distribution.
It was ultimately a satisfying outcome, knowing we were able to navigate those complexities and ensure a fair resolution for my client.
