Moreover, I encourage clients to have open conversations with the potential executor or trustee beforehand, discussing their expectations and responsibilities.
Notwithstanding careful planning, sometimes unforeseen circumstances arise. For example, I once had a client who chose her eldest son as executor. Unfortunately, he passed away unexpectedly shortly before his mother.
This situation created a great deal of stress for the family, but fortunately, they had a backup executor named in the will. It’s essential to have contingencies in place and discuss these possibilities openly with your loved ones.
